Real Estate Frequently Asked Questions (FAQs)

Real estate matters are among the most costly, time-consuming and frustrating challenges in law. At The Law Offices of William T. Peckham in Austin, we are committed to making real estate as simple as possible for you. After nearly 40 years of practice, these are some of the most commonly asked real estate law questions we have heard from our clients:

  • Can’t I just buy or sell property under the table? This is a very bad idea. With so much money on the line, you want to make sure your interests are protected and no issues arise. If you buy property without going through the proper steps, you will have no way of seeking justice if something goes wrong. And without doing proper research on the title, you may find that it is riddled with liens and other claims.
  • What if I can’t afford an attorney? If you can’t afford an attorney, then you definitely can’t afford to have something go wrong. Real estate lawyers are not as expensive as many think, and are definitely much cheaper than having to resolve a real estate dispute in the future.
  • What happens to a loved one’s property if they die without a will? A range of issues could arise surrounding their property, and every case is unique. There could be unresolved liens or claims on the title, you may have multiple family members claiming ownership of the property, or you may find that you are unable to sell the property due to other legal issues. This scenario is extremely difficult to get through alone — reach out to an attorney to make sure all issues surrounding their property are addressed.
  • What happens if I get a mechanic’s lien on my home because a contractor did not pay a supplier? Sometimes, you may be held to blame if a contractor or subcontractor did not pay a supplier for the resources used in your construction project. We work with every party involved to help you remove that lien from your title as quickly and effectively as possible.

Many times, real estate issues encompass a variety of legal areas — more than just real estate law. We have extensive experience in bankruptcy law, creditor rights, civil litigation, tax law, estate planning and more. No matter what challenge you face in relation to your property, we can help.
